Understanding Fire Safety Law

The Regulatory Reform (Fire Safety) Order 2005 is the primary legislation covering general fire safety in England and Wales, supported by the Fire Safety Act 2021 and subsequent regulations.

As an employer, building owner, landlord or occupier — you are the Responsible Person. You are legally required to ensure a suitable and sufficient fire risk assessment is carried out and kept up to date. Failure to comply can result in enforcement action, improvement notices, or prosecution.

Relevant Standards

Assessments are conducted in accordance with PAS 79-1:2020 (non-domestic premises) and BS 9792:2025 (housing), published by the British Standards Institution (BSI).

As the Responsible Person you must:

  • Carry out a suitable and sufficient fire risk assessment and keep it up to date
  • Inform staff, residents or their representatives about identified fire risks and how they are managed
  • Put in place and maintain appropriate fire safety measures proportionate to the risk
  • Plan for an emergency, ensuring escape routes are available, understood and practised
  • Provide information, instruction and training on fire safety and emergency procedures
  • Review the assessment regularly or following significant changes to the premises

Do I legally need a fire risk assessment?
If you are an employer, or you own, manage or have control of any non-domestic premises — including premises let to paying guests such as holiday lets — you are the Responsible Person under the Regulatory Reform (Fire Safety) Order 2005 and you must ensure a suitable and sufficient fire risk assessment is carried out and kept up to date. Where five or more people are employed, the significant findings must be recorded in writing, and recording is considered good practice in all cases.
How much does a fire risk assessment cost?
Our fire risk assessments start from £325 for smaller premises, with larger or more complex premises from £425. Multi-site portfolios and specialist premises are quoted individually. Every quote is fixed before we attend — no hidden fees or surprises after the site visit.
How long does a fire risk assessment take?
The site visit typically takes between one and three hours depending on the size and complexity of the premises. Your full written report is normally delivered within 7–10 days of the visit, complete with photographic evidence and a prioritised action plan.
How often should a fire risk assessment be reviewed?
A fire risk assessment should be reviewed regularly — annually is widely accepted good practice — and immediately following any significant change to the premises, its use or its occupancy, or after a fire or near miss. We offer review and update services for existing assessments.
Do holiday lets in Wales need a fire risk assessment?
Yes. The Regulatory Reform (Fire Safety) Order 2005 applies to premises let to paying guests, which includes self-catering holiday lets and short-term rentals. Updated Home Office guidance published in October 2023 sets out what is expected, and Welsh fire and rescue services actively enforce these requirements.
What happens during the assessment?
We inspect all accessible areas of the premises, identify fire hazards and the people at risk, evaluate your existing fire safety measures — detection, means of escape, fire doors, emergency lighting, firefighting equipment and management arrangements — and review your documentation. You then receive a clear written report with prioritised findings, recommended actions and realistic timescales.
